Texas Man Sues Whataburger Over Allergic Reaction from Onions
In a surprising legal move, Demery Ardell Wilson has filed a lawsuit against Whataburger, claiming negligent behavior after allegedly receiving onions in a meal, despite his request for none. The suit, lodged on April 25 in Harris County’s 269th Judicial District Court, states that on July 24, 2024, Wilson suffered an allergic reaction that necessitated medical attention after eating at a Whataburger location.
Wilson asserts that the fast-food chain failed to meet the appropriate standard of care by not honoring his request, leading to a "manufacturing defect.” The lawsuit describes the meal as "defective" and "unreasonably dangerous," given the inclusion of onions—a known allergen for the plaintiff. Wilson seeks damages between $250,000 and $1 million, which may include expenses and penalties, with the possibility of amending this figure as legal proceedings develop.
