A federal judge has temporarily blocked President Trump’s attempt to use the Alien Enemies Act of 1798 to deport suspected members of a Venezuelan gang, Tren de Aragua, accusing them of infiltrating the United States and using drug trafficking against American citizens. The judge ordered deportation flights carrying those subject to Trump’s proclamation to return to the United States.

The decision came after the ACLU and Democracy Forward filed a lawsuit accusing the White House of preparing to deport five Venezuelan men. The judge expanded the ruling to apply to all non-citizens in custody subject to Trump’s proclamation.

While the Justice Department plans to appeal the ruling, the judge emphasized the need for immediate compliance. Legal experts have challenged Trump’s interpretation of the Alien Enemies Act, arguing that it was meant for wartime use. Trump’s use of this law marks the first time in nearly a century outside a major military conflict.

Democratic lawmakers have long sought to repeal the Alien Enemies Act to prevent discriminatory practices harming immigrant communities. The case is ongoing, with a scheduled hearing on March 21 for further arguments.
