A recent study by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University has revealed significant disparities in asylum denial rates by judges in federal immigration cases in the United States. According to the research, the immigration courts in New York and San Francisco have the highest range in asylum denial rates, with judges in these locations denying asylum more than 90% of the time. On the other hand, some judges deny asylum in less than 4% of cases.

However, TRAC researchers have clarified that these discrepancies do not necessarily indicate bias among judges, but may be influenced by factors such as the size of the court. For example, Hartford’s immigration court, which has only three judges, consistently denies asylum between 65 to 75% of the time. The findings suggest that the size and composition of the court may impact the likelihood of asylum being granted.
