Colorado high school to be investigated by Education Department for installation of all-gender restroom


The U.S. Department of Education’s Office for Civil Rights is investigating Denver Public Schools for alleged discrimination against female students for converting a women’s restroom into an all-gender facility at East High School. The installation of the bathroom left male students with an exclusive restroom and no restroom for female students on the second floor. The district is being investigated for potential Title IX violations as a recipient of federal financial assistance. The district claims the restroom was added through a student-led process to serve all students, including those uncomfortable in gender-specific facilities. The restroom has high partitions and faculty supervision. The district cited cost concerns for not converting the men’s restroom into an all-gender facility. Those uncomfortable with the new restroom are encouraged to use other facilities. The investigation is not necessarily an indication of wrongdoing and data and personnel access requests will be submitted. The Office for Civil Rights’ investigation follows recent executive orders by President Trump targeting gender-related issues, including changes to federal DEI programs and transgender military service. These changes have led to the shutdown of employee resource groups, like DOJ Pride, at the Department of Justice.
