Supreme Court to Consider Reinstating Obamacare Requirements Overturned by Lower Court – NBC Connecticut


The Supreme Court has agreed to review a case regarding preventative care coverage requirements under the Affordable Care Act that were struck down by a lower court. The federal government appealed after the 5th U.S. Circuit Court of Appeals ruled in favor of employers who objected to being required to provide full insurance coverage for certain preventive care services. The ruling raised religious and procedural objections, chipping away at Obamacare.

While some preventive care services like mammography and cervical cancer screenings would still be covered without out-of-pocket costs, other services like statins to prevent heart disease and HIV prevention medications may not be covered under the ruling.

For now, the requirements remain in place for all but the eight companies that sued. The 5th Circuit found that the coverage requirements were adopted unconstitutionally coming from a body whose members were not nominated by the president and confirmed by the Senate.

The Supreme Court is expected to hear the case in the spring, bringing attention to the ongoing debate over healthcare coverage and the Affordable Care Act.
