President-elect Donald Trump and his former co-defendants in a Florida classified documents case are seeking to block the release of a final report by special counsel Jack Smith, who previously prosecuted the case. The lawyers for the defendants claim that Smith’s appointment was unconstitutional and that his report is biased and one-sided. They have filed a motion asking the court to prevent the release of the report, believing it to be imminent.
Trump’s lawyers have also sent a letter to Attorney General Merrick Garland urging him to stop Smith from releasing the report, alleging that Smith is an “out-of-control private citizen unconstitutionally posing as a prosecutor” with the aim of politically harming Trump. They have requested that Smith be removed promptly.
The Justice Department, which is required to provide a confidential report to Garland under its regulations, has not yet commented on the matter. It is reported that Smith and his team plan to resign before Trump takes office on January 20. Despite the dismissal of the case against Trump due to the long-standing policy of not prosecuting sitting presidents, federal prosecutors are still appealing Cannon’s dismissal of the charges against Nauta and De Oliveira from the same case.
