Constitutional amendments in 10 states are set to appear on the general election ballot to protect or expand abortion rights. In swing states like Arizona and Nevada, as well as blue-leaning states like Colorado, Maryland, and New York, voters will have the chance to directly decide on the future of abortion access. The proposed amendments vary by state, such as Arizona creating a fundamental right to an abortion up until fetal viability, while Colorado aims to prevent government denial or discrimination against the exercise of that right. In Florida, a proposed amendment would bar restrictions on abortion before fetal viability, while Maryland lawmakers are seeking to enshrine abortion rights in the state constitution. Missouri’s amendment would protect abortion rights up until fetal viability, with exceptions for the life and health of the mother. Montana’s ballot measure would provide a right to make decisions about one’s own pregnancy, including the right to abortion. In Nevada, rights protecting abortion up until fetal viability would be enshrined in the state constitution. South Dakota’s proposed amendment would legalize abortion in the first trimester and allow state regulation in the second trimester, with the prohibition in the third trimester unless necessary to preserve the woman’s life or health. Each state’s proposed amendment requires a different percentage of voter support for passage in November.
