Fernando Cluster had emergency surgery for bleeding into the brain in September 2022, during which a bone flap was removed with the intention of reattaching it in a later surgery. However, when Cluster returned for the follow-up operation in November 2022, the hospital could not locate the bone flap because of incomplete patient identification on several flaps. This led to Cluster receiving a synthetic flap, causing infection and requiring another surgery, resulting in a longer hospital stay and additional medical expenses. The couple claims that Cluster has been unable to work, their family relationship has been affected, and he has suffered permanent injuries due to the hospital’s negligence. The lawsuit does not specify the amount being sought but mentions seeking general and special damages. Emory Healthcare declined to comment on the pending litigation but emphasized their commitment to high-quality care. The lawsuit highlights the emotional and economic impact of medical negligence on patients and their families.
